1. The Financial Setup (NRE vs NRO under RBI & FEMA Guidelines)
Before you look at a single plot, get your banking in order. Under the Foreign Exchange Management Act (FEMA), 1999 and RBI Master Direction No. 13/2015-16, Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs) are permitted to acquire residential or commercial real estate in India. Routing investment funds through your NRE (Non-Resident External) account ensures that principal sale proceeds remain fully repatriable. Mixing funds via non-compliant NRO transfers can create tax withholding complexities upon exit.
2. The Power of Attorney (PoA under Indian Registration Act 1908)
You don't need to fly down for every signature. Pursuant to Sections 32 & 33 of the Indian Registration Act, 1908, a Specific Power of Attorney (PoA)—duly executed before a Public Notary and attested by the Indian Embassy/Consulate in your country of residence—allows a designated attorney to represent you solely for a specified property transaction.
Advice: Avoid General Power of Attorney (GPA) agreements for real estate acquisition, as Indian courts and sub-registrars strictly require Specific PoA for title deed execution.
3. The "Remote" Site Visit & Legal Verification
A video call isn't enough. We encourage our NRI clients to send a local trusted contact to verify:
- Physical possession & boundary demarcation (ensuring zero encumbrances on 7/12 Satbara)
- Actual distance from main arterial roads (maps can be deceiving)
- Sanctioned Town Planning (TP) scheme access roads
4. Maintenance & Property Tax Stewardship
Buying is easy; holding is hard. Property tax compliance under local Nagarpalika regulations, seasonal land clearing, and perimeter fencing protect your asset value. Partnering with experienced local stewardship prevents unauthorized encroachment.
